Understanding Demerit Point Suspensions in New Zealand

Things many drivers don't realise...

Receiving a demerit point suspension can have significant consequences for your employment, family commitments, and everyday life. If you accumulate 100 or more demerit points within a two-year period, the New Zealand Transport Agency (NZTA) will suspend your driver licence for three months.

The timing of your suspension is not always straightforward. Depending on your circumstances, you may be served with a suspension notice by Police during a traffic stop, receive a Notice of Suspension by post from NZTA, or, in some situations, choose to surrender your licence at a Police station. Each option can have different practical consequences, making it important to understand your position before your suspension begins.

Because every situation is different, it's important to understand all of your options before your suspension starts. In some cases, there may be opportunities to better understand how the timing of your suspension may affect your options, including whether a Limited Licence application may be available.

Three Ways a Demerit Suspension Can Begin

Police Suspension Notice
If you are stopped by Police and it is identified that you have accumulated 100 or more demerit points, Police may immediately serve you with a Notice of Suspension. Your suspension begins immediately, and you must stop driving from that moment.

Notice of Suspension by NZTA
If Police do not personally serve you, NZTA may post a Notice of Suspension to your last known address. The suspension generally takes effect from the date specified in the notice.

Voluntary Surrender of Your Licence
In some circumstances, it may be possible to surrender your driver licence at a Police station and commence your suspension at a time that better suits your personal or employment circumstances. This option is not available in every situation, so it's important to obtain advice before making any decisions.
